1. Acceptance of Terms
By accessing or using Compel's church hospitality management platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Compel ("we," "our," or "us").
2. Description of Service
Compel is a church hospitality management platform that helps churches care for their members and guests through team organization, care needs tracking (prayer requests, meal coordination, visit scheduling), attendance management by worship sections, and member interest-based connections.
3. Account Registration
To use the Service, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Upload, transmit, or store any content that is defamatory, obscene, or violates the rights of others.
- Attempt to gain unauthorized access to other accounts, systems, or networks connected to the Service.
- Use the Service to send unsolicited or unauthorized messages, including spam.
- Interfere with or disrupt the integrity or performance of the Service.
- Violate any applicable local, state, national, or international law or regulation.
5. Data Ownership and Responsibility
You retain ownership of all data you enter into the Service, including member information, visitor records, care needs, and attendance data. You are solely responsible for the accuracy, legality, and appropriateness of all data you input.
You represent and warrant that you have obtained all necessary consents from individuals whose personal information you enter into the Service, in compliance with applicable privacy and data protection laws.
6. SMS/Text Messaging Terms
The following terms apply to SMS and text messaging features of the Service:
- Types of Messages: By opting in to SMS communications, you or your church members may receive care need notifications (prayer requests, meal coordination, visit reminders), attendance alerts, team coordination messages, event reminders, and other church-related service messages.
- Message Frequency: Message frequency may vary depending on the services opted into and your church's communication needs. Recurring messages may be sent.
- Message and Data Rates: Message and data rates may apply. Please contact your wireless carrier for details about your text messaging plan and any charges that may apply.
- Opt-Out: You may opt out of receiving SMS messages at any time by replying STOP to any message you receive from us. After opting out, you will receive a confirmation message and will no longer receive SMS messages from the opted-out program.
- Help: For help or questions about SMS messaging, reply HELP to any message, or contact us at support@compel.app.
- Privacy: Your mobile phone number and SMS opt-in information will not be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. For full details, please see our Privacy Policy.
- Supported Carriers: Service is available on most major US wireless carriers. Carriers are not liable for delayed or undelivered messages.
7. Consent for Communications
By providing your phone number and opting in to SMS messaging, you consent to receive text messages from Compel related to the services described above. Consent to receive text messages is not required as a condition of purchasing any goods or services. You may opt out at any time as described in Section 6.
Churches using the Compel platform are responsible for obtaining proper opt-in consent from their members and visitors before sending SMS messages through the platform. Consent must be clearly documented and separate from any other agreements.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.
9. Intellectual Property
The Service, including its design, features, code, and branding, is owned by Compel and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
10. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service at any time, with or without notice. We are not liable for any downtime or service interruptions.
11. Limitation of Liability
To the maximum extent permitted by law, Compel shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service. Our total liability shall not exceed the amount paid by you to Compel in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Compel and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any applicable laws or regulations.
13. Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
